JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Nowkothi P.S. Case No. 63 of 2020 registered for the offence punishable under Section 392 of the Indian Penal Code 1860. The prosecution case, as per the First Information Report, is that three unknown criminals allegedly snatched the Motorcycle of the informant on gun point.
Learned counsel for the petitioner submits that the name of the petitioner has transpired in this case on the basis of confessional statement of co-accused Sonu Kumar and the looted Motorcycle has not been recovered from possession of the petitioner and the same has been recovered from possession
Patna High Court CR. MISC. No.2429 of 2022(2) dt.26-05-2022 2/2 of the co-accused Sonu Kumar. The petitioner is in custody since 24.09.2020.
Regards being had to the submission made by the parties and taking into consideration the period of custody of the petitioner and the fact that no looted article has been recovered from possession of the petitioner, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeVIII, Begusarai, in connection with Nowkothi P.S. Case No. 63 of 2020 subject to the condition that the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
