The petitioner seeks bail in anticipation of his arrest in connection with Khodawandpur P.S. Case No. 145 of 2019 dated 18.07.2019 instituted for the offences under Sections 272, 273 and 120(B) of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the prosecution report that from two vehicles, approximately 1833 liters of liquor was recovered. One Ram Babu Yadav is said to have made confession before the police in which he has named the petitioner as one of the persons involved in such trade and also in unloading the aforesaid consignment of liquor Learned counsel for the petitioner has submitted that except for the confession of the co-accused person referred to above ,there is no other material to connect the petitioner with the offence.

Learned counsel for the petitioner has further submitted that some of the similarly situated accused persons have been granted anticipatory bail by this Court and by the other co-ordinate Benches. The petitioner does not have criminal antecedents.

For the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before he Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bond in the sum of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Begusarai, in connection with Khodawandpur P.S. Case No. 145 of 2019 subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
