The petitioner is languishing in custody since 25.01.2015 in a case registered for the offences punishable under Sections 354B and 376/511/34 of the Indian Penal Code. It is alleged that on 03.09.2014 the petitioner and one Bhola Yadav outraged the modesty of the informant and took her in a bush and made attempt to establish forceful physical relationship by stripping her.
It is submitted by learned counsel for the petitioner that even assuming the accusation no offence under Section 376/511 of the IPC is made out. Earlier the father of the informant lodged a case with similar accusation in connection with
Patna High Court Cr.Misc. No.14958 of 2015 (02) dt.07-05-2015 2/2 the sister of the informant wherein the sister of the informant in 164 Cr.P.C. statement denied the accusation of kidnapping and police submitted final form and hence, the present case has been lodged. The investigation has already concluded. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Nawada in connection with Sirdala P.S.
