Both the criminal miscellaneous applications are related to the same Sessions Trial No. 298 of 2013 arising out of Kasim Bazar P.S. Case No. 06 of 2013 registered under Sections 399, 402, 307, 353 of the Indian Penal Code and 25(1-b)A, 26, 27, 35 of the Arms Act. Hence, both the applications are disposed of

Patna High Court Cr.Misc. No.12599 of 2015 (2) dt.15-04-2015 2/2 by this common order.

Learned counsel appearing on behalf of the petitioners submits that earlier prayer of the petitioner for bail was rejected on 24.01.2014 vide Cr. Misc. No. 29660 of 2013 with direction to the trial Court to conclude the trial preferably within one years, but till 30.01.2015 the charge has not been framed. The date of framing the charge was fixed on 27.02.2015, which would appear from the order dated 20.01.2015 passed by the Additional District Judge IIIrd, Munger. It is also submitted that both the petitioners are in custody since 17.01.2013.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Ad hoc A.D.J. IIIrd, Munger in connection with Sessions Trial No. 298 of 2013 arising out of Kasim Bazar P.S. Case No. 06 of 2013. Out of two sureties, one surety must be close relatives/parents of the petitioners.
