JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and one F.I.R. named accused are said to had been pressurizing the informant since last ten days to establish physical relation but when she refused, she was assaulted by the petitioner and his associates and also attempted to commit rape on her.
Contention on behalf of the petitioner is that the present case was lodged on account of previous enmity and village politics. Moreover, no case under Section 376 read with Section 511 of the Indian Penal Code is made out and rest sections are bailable in nature.
