The petitioner is languishing in custody for the offences punishable under Section 354 of the Indian Penal Code and 8/12 of the POCSO Act.

The statement of the victim girl, recorded under Section 164 Cr.P.C., a copy at Annexure-2, would reveal that the petitioner was her teacher and has taught her. The petitioner touched her for incorrectly writing something and not with some illicit motive.

Considering the statement of the victim girl, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below

Patna High Court CR. MISC. No.1267 of 2020(2) dt.16-01-2020 2/2 where the case is pending in connection with Special Case No.185 of 2019, arising out of Alamganj P.S. Case No.696 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the Court.
