This is an application for bail in a case of misuse. The petitioner was earlier granted bail in a case registered for the offences punishable under Sections 399,402 of the Indian Penal Code, 25(1-B)a/26/35 of the Arms Act and 3/4 of Explosive Substances Act. The bail bond of the petitioner was cancelled on 11.04.2013. The petitioner was subsequently arrested on 11.09.2014.
It is submitted by learned counsel for the petitioner that the petitioner henceforth regularly appear before the learned court below.
Considering the fact that the impugned order
Patna High Court Cr.Misc. No.9001 of 2015 (02) dt.12-03-2015 2/2 does not reflect that any progress has been made in the trial since the arrest of the petitioner on 11.09.2014 and the undertaking on behalf of the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Patna in connection with Sessions Trial No. 1080 of 2010 arising out of Jakkanpur P.S. Case No. 118 of 2010.
The learned court below will positively cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
