The petitioner apprehends his arrest in Khanpur P.S. case No. 160 of 2018 registered under Section 30(a), 41 (1), 2 and 47 of the Bihar Prohibition & Excise Act. The informant, a police official, got information that Barun Thakur used to keep illicit liquor in his closed brick kiln and with the help of his brother Lakshman Thakur and Monu Thakur, the petitioner, used to sell the liquor. When the police went to verify the information the police found three persons fleeing away from the place of occurrence.
The learned counsel for the petitioner submits that petitioner has got no concern with the brick kiln nor the petitioner was ever found involved in illicit liquor business. Considering the facts aforesaid and the nature of

No.4316 of 2019(2) dt.28-01-2019 2/2 allegation made against the petitioner and the fact that petitioner has got not concern with the brick kiln, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III-cumSpecial Judge, Excise Act, Samastipur in connection with Khanpur P.S. Case No. 160 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
