JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Barahia P.S. Case No. 29 of 2015, registered under Sections 302 and 201/34 of the Indian Penal Code.
The accusation is that the marriage of Punam Devi, daughter of informant/complainant Chandra Deep Singh was performed with the petitioner before ten years, but, she was being tortured by her husband and other in-laws for demand of dowry. In the meantime, she was blessed with three children aged about 8 years, 6 years and 8 months. On 14.09.2014, informant came to know that his daughter has been killed by her husband and other in-laws.

No.4439 of 2020(3) dt.29-05-2020 2/3 Learned counsel for the petitioner submits that, admittedly, the marriage of petitioner was performed with the deceased Punam Devi before ten years and due to their wedlock, they have been blessed with three children. Further submission is that, in fact, deceased Punam Devi, wife of petitioner, sustained burn injury in course of cooking meal. Thereafter, she was rushed to the Hospital for treatment, but she died and information in that regard was also given to her father, who is the informant of the present case and he also participated in her last rituals, but in anger, the informant lodged the present case. After investigation, the Police submitted Final Form, but differing with the Final Form, cognizance taking Court took the cognizance of the offence. Thereafter, the case was committed to the Court of Session numbered as S.T. No.133 of 2019, in which all have stated the real fact about the death of the deceased due to burn injury received in course of cooking meal. The petitioner is in custody since 15.08.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the
