The petitioner apprehends his arrest in connection with Tajpur P.S. Case No.419 of 2022, registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

Allegation against the petitioner is that he took 860 quintals of paddy from 22 farmers and misappropriated Rs.16,89,900/-, which is the price of paddy at the rate of Rs.1965/- per quintals.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the petitioner has already deposited Rs.6,00,000/- in Co-

Considering the submissions that petitioner has already deposited Rs.6,00,000/- in Co-operative Bank, Samastipur on 09.09.2022 and he is also ready to deposit the rest amount, i.e., Rs.10,89,900/-, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on provisional anticipatory bail for eight months, on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Samastipur in connection with Tajpur P.S. Case No.419 of 2022, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.

The learned court below shall confirm the provisional anticipatory bail granted to the petitioner by this Court after verifying the fact that the petitioner has already deposited the entire amount.
