JUSTICE PRABHAT KUMAR JHA ORAL ORDER 24-04-2015 Learned counsel for the petitioner is permitted to make necessary correction in para-1 of the bail petition. Heard both sides.

The petitioner seeks bail in Runni Saidpur P.S. Case No. 29 of 2013, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Section 27 of the Arms Act. Later on Section 302 of the Indian Penal Code was added.

The petitioner is not named in the FIR. Two persons namely Akhileshwar Prasad and Kamleshwar Prasad are said to have been injured. Kamleshwar Prasad died during the course of treatment.

Learned counsel for the petitioner submits that during

Patna High Court Cr.Misc. No.14421 of 2015 (2) dt.24-04-2015 2/2 the course of investigation, it has come that Pappu Khan fired at Kamleshwar Prasad and Sanjay Sahni also fired injuring Akhieleshwar Prasad Yadav. It is further submitted that Naresh Das, Sanjay Sahni and Manoj Sahni have been granted bail by this Court vide order passed in Cr. Misc. No. 9235 of 2015, Cr. Misc. No. 16727 of 2014 and Cr. Misc. No. 39019 of 2014. The case of the petitioner stands on the same footing.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S. Case No. 29 of 2013.
