JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 Heard the learned counsel for the petitioners, the informant and the State.

Both the cases have been heard together as they arise out of same police station case number and are being disposed off by this common order. These petitions are for grant of regular bail for offence under Sections 302, 201 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that a day prior to the recovery of the dead body of the deceased the petitioners have said to have accompanied the deceased to Mela, except for this there is no allegation against the petitioners. It is, further, submitted on behalf of the petitioners

Patna High Court Cr.Misc. No.15875 of 2015 (2) dt.09-06-2015 2/2 that there is no direct or indirect evidence to suggest the implication of the petitioners, except for the suspicion raised in the first information report. It has, further, been submitted on behalf of the petitioners that the petitioners have got no criminal antecedents and the petitioners are in jail custody since 24.09.2014 and 18.09.2014 respectively. On behalf of the State and the counsel for the informant it has been submitted that it is a case of last seen and, thereafter, the dead body of the deceased was found on the next day in the evening. Further, it has been submitted that there was some money which was due and for the said reason the present occurrence is said to have been taken place.

Considering the aforesaid facts and circumstances, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Patani P.S. Case No. 78 of 2014 to the satisfaction of Sri D. Kumar, Judicial Magistrate, 1st Class, Sikrahana at Motihari, East Champaran.
