JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but the informant is not an eye witness of the alleged occurrence. The petitioner was produced before the police by the informant and others and after that, allegedly, the petitioner confessed his guilt. However, in course of investigation, two witnesses claimed to have seen the petitioner with the deceased, prior to the alleged occurrence and except the aforesaid materials, there appears to be nothing against the petitioner.
Contention on behalf of the petitioner is that one witness namely, Ganesh Sah has been examined in course of trial but he has not supported the prosecution case.. It is further pointed
Patna High Court Cr.Misc. No.3411 of 2016 (3) dt.18-02-2016 2/2 out that petitioner is in jail custody since long and except suspicion, there is nothing against him.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Manjhi P.S. Case No. 178 of 2013 corresponding to Sessions Trial No. 144 of 2014 to the satisfaction of learned Additional District & Sessions Judge-II, Saran at Chapra. One of the sureties must be close relative of the petitioner.
