2. The petitioner has preferred this application for grant of regular bail in connection with Rupaspur P.S. Case No. 736 of 2023 dated 08.09.2023 registered for the offences punishable u/s 356 and 379 of the I.P.C.
3. As per the prosecution case, on 08.09.2023 at about 3:30 P.M., the informant was returning to his Timber Office, Rupaspur after withdrawing Rs. 5,00,000/- from SBI Bank, Jagdeopath, in the meantime, two miscreants boarded on two motorcycles intercepted the informant and snatched his bag containing cash of Rs. 5,00,000/- and fled away. Accordingly, the FIR has been registered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the alleged recovery. The petitioner is not named in the FIR. No TIP has been conducted by the prosecution. The name of the petitioner has transpired merely on the basis of self confessional statement of the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has two antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 02.08.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner was apprehended in Rupaspur P.S. Case No. 317 of 2024 and confessed his involvement in the alleged loot of Rs. 5,00,000/- and also identified in the CCTV footage installed near the place of occurrence. It is further submitted that the charge sheet has already been submitted against the petitioner under Section 356, 379 and 392 of the I.P.C.
6. Considering the aforesaid facts and circumstances of the case and the nature of allegation levelled against the petitioner as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.2844 of 2025(2) dt.25-02-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Rupaspur P.S. Case No. 736 of 2023.
