Petitioner is not named in the first information report and after due investigation, police submitted final form showing mistake of fact but subsequently, on the basis of protest-cum- complaint petition matter proceeded and after enquiry, petitioner has been summoned.

However, in course of enquiry, none of witnesses claimed to have seen the petitioner committing the alleged crime and have claimed only to this extent that petitioner and some other co-accused having rifles and country made pistols were returning from the place of the occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.12367 of 2015 (2) dt.25-03-2015 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IV, Bhojpur at Ara in Sessions trial no. 263/2014 arising out of Protest Complaint no. 260 C/2013.
