Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
No doubt, earlier the prayer for bail of the petitioner was rejected by this court but submission on behalf of the petitioner is that having similar allegation, co-accused, Ranjeet Yadav and Indal Yadav have already been granted privilege of bail and moreover, petitioner is in jail custody since 22.02.2013 and up till now, prosecution evidence could not be concluded. Considering the aforesaid submissions as well as period of detention of the petitioner in jail custody and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Barh, Patna in connection with Sessions Trial No. 358 of 2014 arising out of Bakhtiyarpur P.S.
