Petitioner is in jail custody since 26.06.2012 in a case registered under section 304 B, 201 and 120 B of the Indian Penal Code and earlier, his prayer for bail was twice rejected by this Court.

However, while rejecting the prayer for bail of the petitioner vide order dated 22.04.2015 passed in Cr. Misc. No.9869 of 2015, this court directed the trial court to conclude the trial of the petitioner within six months from the date of receipt / production of a copy of the said order and liberty was given to the petitioner that he may renew his prayer before the court below, if the trial is not concluded within the above stated period. The impugned order dated 20.11.2015 goes to show

Patna High Court Cr.Misc. No.3036 of 2016 (2) dt.16-03-2016 2/2 that up till now only three prosecution witnesses could be examined and still the case of the petitioner is pending for recording the prosecution evidence.

Considering the stage of the trial of the petitioenr as well as period of detention of the petitioner in jail custody as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Danapur, Patna in connection with Sessions Trial no 237 of 2013/ Trial No. 620 of 2015 arising out of Dulhin Bazar P.S.Case No.88 of 2012.
