1. The Writ petition is filed in the nature of mandamus commanding and directing the respondent concerned to cancel the selection of private respondent No. 7, granting the award of Kisan Seva Kendra dealership within 1 K.M. from Benibad Chouk towards Gangeya on Kewtara, Aurari Road, District- Muzaffarpur under O.P. category, pleading wrong description of required width of
Patna High Court CWJC No.16287 of 2017(2) dt.18-06-2025 2/3 lands. As per the advertisement, he does not possess the required width of land, but subsequently, even after being allowed to participate in process of draw, though he was not eligible to participate in the draw, in collision with respondent authorities, and after the draw process, he procured some other lands to fulfill the required criteria of width of land, and on that basis, he is being offered the award, which is illegal in eye of law. Further, a direction is sought to the respondent authorities to conduct an enquiry with regard to description of lands provided by private respondent No. 7 in the original application form the documents furnished by him to support the required criteria as per the advertisement. Further, to grant an award an ward of dealership to the petitioner, as he fulfills the required criteria as per advertisement within the prescribed period for submission of the application, but his valid claim is being denied.
2. A detailed counter affidavit was filed by the Indian Oil Corporation Ltd. It is contended by the Learned counsel for the respondent that a complaint was received against respondent No.7,
Patna High Court CWJC No.16287 of 2017(2) dt.18-06-2025 3/3 Sri Rakesh Kumar, from the Writ petitioner on 24.01.2017 and 30.01.2017 regarding the plot offered by the selected applicant not fulfilling the terms of selection. As per the Selection Manual, an investigating officer was appointed, and documents were sought by the investigating officer from the petitioner and the respondent, and after a detailed enquiry, the selection of respondent No. 7 was cancelled on 31.03.2018. As the grievance of the petitioner was redressed, the Learned counsel for the respondent prayed to dismiss the Writ petition.
3. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondent-IOCL.
4. Considering the aspect that the selection of respondent No. 7 has been cancelled and nothing remains in the Writ petition for further adjudication, the Writ petitioner is dismissed as it devoids of its merit.
