The petitioner being the husband of the victim is languishing in custody since 24.01.2014 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after four years of the marriage since the victim objected the illicit relation of the petitioner with Ranju Devi, the brother's wife of the petitioner as a result this petitioner assaulted the victim with brick and stick resulting the death of the victim and subsequently disposed of the dead body.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.11414 of 2015 (04) dt.29-06-2015 2/2 petitioner that the informant admittedly is not the eye witness to the occurrence and on suspicion the accusation has been levelled. Considering the fact that the case was instituted in 2006, the petitioner is in custody since 24.01.2014 and thrust of accusation against this petitioner, this Court is not inclined to grant bail to the petitioner in connection with Sessions Trial No. 672 of 2014 arising out of Aurai P.S. Case No. 62 of 2006 pending in the court of learned Additional Sessions JudgeVII, Muzaffarpur. Accordingly, the prayer for bail of the petitioner is rejected.
