JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sahebpur Kamal P. S. Case No. 297/2015 registered for offences punishable under sections 341, 324, 307 and 504/34 of the Indian Penal Code. The accusation is that in course of quarrel between the family of the petitioner and the informant, the petitioner made intervention and shot fire through pistol, causing injury on the thigh of Kurban Kumar, son of the informant.

The photocopy of the injury report of Kurban Kumar which is attached with photo copy of case diary shows that a lacerated bleeding wound over enterior aspect of left thigh was

No.2767 of 2016 (3) dt.18-03-2016 2/2 found in size 1⁄4 x 1⁄4 inch, more than 2 inch deep and nature of injury is kept reserve till report of Sadar Hospital, Begusarai Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was apprehended on the spot by the villager but arm was found with the petitioner. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 16.07.2015. Considering the facts and circumstances, the above named petitioner, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 3rd . Begusarai in connection with Sahebpur Kamal P.S.Case No. 297/2015.
