26-04-2022 Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the offence under Sections 302, 120(B) of the Indian Penal Code. As per the prosecution case, on 27.05.2021, son of the informant alongwith one Anil Kumar Sah went to purchase medicines on 4-wheeler (Celerio Car), but he did not return and on the next day, the informant came to know that the vehicle in question has been destroyed due to fire and the body of son of informant and Anil Kumar Sah was found burnt, leading to registration of F.I.R. against unknown. During course of investigation, the informant, in his re-statement, has suspected the hand of petitioner and other co-accused persons in the murder of his son.

It is submitted on behalf of petitioner that save and except suspicion, there is no other material against this

None of the witnesses, who were examined during course of investigation, alleged any overt act against this petitioner or seen him committing the offence. Petitioner has got clean antecedent and he is in custody since 19.07.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge 5th, Supaul in connection with S.T. Case No. 330 of 2021, arising out of Chhatapur P.S. Case No. 150 of 2021. (Prabhat Kumar Singh, J) anay/- U T
