None ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 24-02-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. None appears for the informant though on earlier occasion, learned counsel for the informant had appeared.

3. As per the allegation, the petitioner is accused of taking Rs. 60,000/- from the informant.

4. Learned counsel for the petitioner on the last occasion has taken instruction and was ready to pay Rs. 1,00,000/- to the informant.

5. Today the informant has not appeared.

6. In these circumstances, this application is allowed.

7. Accordingly, in the event of arrest or surrender

Patna High Court CR. MISC. No.1130 of 2025(9) dt.24-02-2026 2/2 before the Court below within six weeks from today, the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Bettiah, West Champaran/ concerned Court in connection with Sirisiya P.S. Case No. 43 of 2024, subject to the conditions laid down in Section 482 of the BNSS/ 438(2) of the Code of Criminal Procedure, 1973.

8. At the time of surrender, the petitioner shall produce a demand draft of Rs. 1,00,000/- in favour of the informant and deposit the same in the Court below. After deposit of the aforesaid demand draft, the bail bonds of the petitioner shall be accepted.

9. Thereafter, the Court below will release the Bank draft to the informant. In case, the informant refuses to accept the Bank draft in the Court below within one month of its deposit, the Bank draft shall be returned to the petitioner who will be at liberty to encash the Bank draft.
