The petitioner seeks bail in connection with Sikti P.S. Case No. 95 of 2017 registered under Sections 363 and 366A of the Indian Penal Code.
Daughter of the informant is said to have been kidnapped by Gopi Paswan along with petitioner, who happens to be grand father of the Gopi Paswan and other family members. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. He has no concern with the aforesaid occurrence. Patna High Court Cr.Misc. No.54844 of 2017 (2) dt.18-12-2017 eloped with Gopi Paswan and used to live with him but she has given statement under Section 164 of Cr.P.C., naming the petitioner as one of the accused involved in her kidnapping under pressure of her father. Similarly situated co-accused namely, Dilip Paswan has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 16.11.2017 passed in Cr. Misc. no. 55320 of 2017. The petitioner has been languishing in custody since 10.06.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Sikti P.S. Case no. 95 of 2017.
