JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-04-2024 The present writ petition has been filed seeking the following relief:- "(i) That the Respondent No. 2 and 4 may be directed to remove the encroachment from the public road situated in Dath Village under Hasanpur Block- Samastipur, bearing Thana No. 85, Khata No.105 (old) 142 (New), Khesra No. 118 (Old) 170 (New), Area- 20 decimal."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Hasanpur, Samastipur for enforcement of the order dated 22.09.2006, passed in Encroachment Case No.01 of 2003, pursuant to the dismissal of
Patna High Court CWJC No.543 of 2024(2) dt.29-04-2024 2/2 the Encroachment Appeal Case No.101 of 2006, vide order dated 10.09.2016. Liberty so sought is granted. 3.
It is needless to state that in case there is no other legal impediment, the Circle Officer, Hasanpur shall take appropriate action for implementation of the order dated 22.09.2006, passed in Encroachment Case No.1 of 2003, as affirmed vide order dated 10.09.2016, passed by the Collector, Samastipur, by taking appropriate action under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of three months from today.

The writ petition stands disposed off on the aforesaid terms.
