The petitioner seeks bail in a case under Sections 420, 467, 468, 471 and 120(B) of the I.P.C.

The petitioner is alleged to have presented a cheque bearing no. 804099 of Rs. 4,84,500/- which is said to have been issued by M/S. Naturo Food and Fruit Products Pvt. Ltd., in favour of M/S. Relax Tour Package and the cheque was presented for inter branch transfer but it was found that the cheque is forged one.

It is submitted that no money was transacted but from perusal of the records, it appears that the petitioner presented forged cheques in different banks and withdrew about Rs.

Patna High Court Cr.Misc. No.11357 of 2015 (6) dt.30-06-2015 2 / 2 33,00,000/- for which Gandhi Maidan P.S. Case No. 351/2014, Hawai Adda P.S. Case No. 214 of 2014, Kotwali P.S. Case No. 675 of 2014 and Economic Offence P.S. Case No. 37 of 2014 and Gardanibagh P.S. Case No. 341 of 2014 have been registered against the petitioner.

It appears that the petitioner is indulged in presenting forged cheques and he has already withdrawn more than Rs. 33,00,000/-.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected in Shashtrinagar P.S. Case No. 601 of 2014, pending in the court of the learned C.J.M., Patna.

The Trial Court is directed to expedite the trial by holding the trial on day to day basis and conclude the same within six months from the date of receipt of this order. If the trial is not concluded within stipulated period, the petitioner may renew his prayer for bail.
