The petitioner seeks bail in Sahebganj P.S. Case No. 4 of 2013, registered for the offences punishable under Section 366 of the Indian Penal Code.

Jailal Bhagat the informant named the petitioner along with two other accused persons and alleged that when his minor daughter was going to attend call of nature the accused persons kidnapped her.

Learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr.P.C. and she disclosed that she had already married with Arjun Bhagat. The victim did not name the petitioner.

Considering the facts that the victim denied the factum

Patna High Court Cr.Misc. No.6304 of 2015 (2) dt.16-02-2015 2/2 of her kidnapping, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Sahebganj P.S.
