JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This application, for grant of anticipatory bail, arises out of Aamadabad P.S. Case No. 146 of 2019, disclosing offences under Sections 366(A), 376, 504, 120(B) and 34 of the Indian Penal Code.
Allegation against the petitioner is that he established physical relationship with the informant and, thereafter, married with her and started living with her but later on family members of the petitioner came and took him with himself and, thereafter, he did not come.
Submission of learned counsel for the petitioner is that the girl is major and is consenting party and petitioner is ready to keep her but his family members is not allowing him to go to the informant.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Aamadabad P.S. Case No. 146 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
