The petitioner seeks bail in Rosera P.S. Case No. 302 of 2014, registered for the offences punishable under Sections 366A and other Sections of the Indian Penal Code.
The informant Binod Mahto alleged that Manish Kumar @ Sarbajeet Sauraj Singh, Ranjit Singh, Pappu Singh and Kanhaiya Singh kidnapped his sister in a vehicle bearing Registration No. BR 33C-7311.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The petitioner happens to be brother-in-law of Manish Kumar @ Sarbajeet Sauraj Singh. Manish Kumar @ Sarbajeet Sauraj Singh is said to have disclosed the name of the petitioner in his confessional statement. Except the
Patna High Court Cr.Misc. No.6307 of 2015 (2) dt.16-02-2015 2/2 confessional statement, there is no material on record to show the involvement of the petitioner. The petitioner is in jail since 08.10.2014.
Considering the facts aforesaid and the fact that the petitioner happens to be brother-in-law of Manish Kumar @ Sarbajeet Sauraj Singh and his name figured in the case in the confessional statement of Manish Kumar @ Sarbajeet Sauraj Singh, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Rosera P.S.
