The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 18 of 2014, registered for the offences punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act. The informant Dilip Kumar named five persons Nitish Kumar, Chotu Kumar, Sopinder Paswan, Rockey Kumar and Rajesh Kumar and alleged that they fired on his father Gouri Rai. The petitioner is not named in the FIR.
Learned counsel for the petitioner submits that the name of the petitioner figured in the case in the confessional statement of Nitish Kumar as one of the assailants of the father of the informant. But, except the confessional statement the police did not collect any tangible material against the petitioner. The
Patna High Court Cr.Misc. No.6312 of 2015 (2) dt.16-02-2015 2/2 informant named five persons and made allegation that only five persons had fired.
Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 18 of 2014.
