JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-05-2018 The learned counsel for the parties are in agreement that the order of punishment dated 19.01.2017 is appealable.
In view of the aforesaid, the learned counsel for the petitioner submits that he may be permitted to file an appeal which may be disposed of by the appellate authority within the specified time frame.
Accordingly, the petitioner is directed to file an appeal within a period of three weeks from today and in case, such
Patna High Court CWJC No.18152 of 2017 (2) dt.02-05-2018 2/2 an appeal is filed within three weeks, the appellate authority shall dispose of the same by a reasoned and speaking order within a period of two months from the date of filing of the appeal after granting an opportunity of hearing to the petitioner herein. It is needless to state that the appeal be disposed of on merits without being influenced by the fact that the appeal might have been preferred after expiry of the stipulated period for filing the appeal. The writ petition is disposed of on the aforesaid terms.
