====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) and other sections of the Bihar Prohibition and Excise Act and section 307/34 and other allied sections of the IPC.
As per the prosecution case, 1500 liters of country made liquor was recovered from the house of co-accused Chhathu Ram and Mukesh Ram.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner's name has figured during course of investigation in confessional statement of co-accused to the effect that the petitioner along with other
Patna High Court CR. MISC. No.2377 of 2022(2) dt.24-03-2022 2/2 accused persons were present in the house of one Chhathu Ram. No body sustained injury as such section 307 IPC would not be attracted against the petitioner. Petitioner claims clean antecedent. Petitioner is in custody since 5.11.2021. Investigation is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the rival submissions of the parties, materials available on the record and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act, Gopalganj in Mohammadpur Police Station Case No. 220 of 2021.
