The petitioner is languishing in custody since 15.10.2018 in a case registered for the offences punishable under Sections 115 and 414 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act. The prosecution case is that secret information was received on 14.10.2018 that six accused persons are going to commit some serious crime, whereupon a raid was laid and consequently, six persons were apprehended from the place of occurrence. It is further alleged that from the possession of coaccused Udit Jha, a pistol was recovered and from the possession of petitioner, a cartridge was recovered. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.2486 of 2019(2) dt.21-01-2019 2/2 that the petitioner has been maliciously roped in the present case. A statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP for the State submits that the petitioner is named in the FIR.

Considering the nature of recovery and the period under custody, coupled with statement made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Muzaffarpur in connection with Maniyari P.S. Case No. 296 of 2018.
