Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected by this court vide order dated 25.6.2015 passed in Cr. Misc. no. 13596/2015 and a very elaborate argument is advanced on behalf of the petitioner to show his false implication in the present crime as well as his innocence.

I am not at all convinced with the submissions of the learned counsel appearing for the petitioner. The trial of the petitioner has already commenced and up till now, three prosecution witnesses have already been examined and, therefore, I do not feel it proper to enlarge the petitioner on bail, at least, at this stage. Hence, his prayer for bail in connection with Saharsa P.S. case no.316/2009 corresponding to Sessions Trial no.

Patna High Court Cr.Misc. No.1304 of 2016 (3) dt.11-05-2016 176/2015 pending in the court of Addl. Sessions Judge I, Saharsa is again rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible even by taking trial of the petitioner on day to day basis. Shahid (Hemant Kumar Srivastava,J) U T
