JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Jamalpur P.S. Case No. 153 of 2019 for the offenses under Sections 302, 201/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 28.7.2019. Except circumstantial evidence, there is no other material to connect the petitioner with the alleged crime. The only material against the petitioner is that he was last seen with the deceased. The petitioner is 60 years old whereas the other co-accused are in the young age group. The story of last seen and suggestion as to commission of crime by the petitioner is ruled out.
