The petitioner seeks regular bail in connection with Amas P.S. Case No. 50 of 2021 (CIS 375/2021) lodged under Section 30(a) of Bihar Prohibition and Excise Act, 2016. As per the F.I.R. total 20 liters country made liquor was alleged to be recovered from possession of the petitioner. Learned counsel for the petitioner submits that charge sheet has already been filed and petitioner is in custody since 23.06.2021. He further submits that there is one criminal case of same nature is also pending against him in which he is on bail. The learned counsel for the petitioner further submits that other co-accused of this case with similar allegation have been

Patna High Court CR. MISC. No.2308 of 2022(2) dt.07-06-2022 2/2 granted bail by a Co-ordinate Bench of this Court vide order dated 10.12.2021 passed in Cr. Misc. No. 45932 of 2021. Learned A.P.P. has opposed the prayer for bail. Considering the facts of the case and after perusal of the records as well as this aspect that charge sheet has already been submitted and petitioner is in custody since 23.06.2021, let the petitioner above named be granted bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise Act, Gaya in connection with Amas P.S. Case No. 50 of 2021 (CIS 375/2021).
