The petitioner seeks bail in a case registered for the offences punishable under Sections 414, 399 and 402 of the Indian Penal Code read with Sections 25 (1) (b), 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of a loaded country-made pistol and one live cartridge from the petitioner, further one knife each was recovered from Md. Rehan and Neeraj. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case,

Patna High Court CR. MISC. No.2726 of 2022(2) dt.25-05-2022 2/2 nothing was recovered from his possession and the petitioner has remained in custody for nearly 10 months. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 17.07.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bahadurpur P.S. Case No. 380 of 2021.
