2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code and later on Section 411 and 414 of the IPC and Section 25(i-b)a, 26, 27 and 35 of the Arms Act.
3. As per allegation in the FIR, informant purchased Dezire car and he has parked his vehicle at Jacidih Railway Station. A group of four persons have hired his vehicle for visit to Bihta. On way to Bihta, accused persons on pistol point looted him and ousted the informant from his vehicle and took away his vehicle
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. On the basis of CCTV footage, name of four persons have surfaced in
Patna High Court CR. MISC. No.1744 of 2024(2) dt.24-01-2024 2/2 this case. Petitioner is businessman dealing with scrap work for which he used to purchase second hand old vehicle. So far as vehicle is concerned, petitioner has purchased it second hand after payment of Rs. 1,30,000/- without verifying the fact that the said fact is stolen one. Similarly situated other co-accused person has already been granted bail by this Court vide order dated 18.01.2024 passed in Cr. Misc. No. 1566 of 2024. Petitioner has got no criminal history and languishing in judicial custody since 28.09.2023.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMI, Danapur, Patna in connection with Bihta P.S. Case No. 697 of 2023.
