The petitioner is in custody on his remand since 12.09.2018 in connection with Ahiyapur P.S. Case No. 799 of 2018 for the offence registered under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the first information report has been lodged against the unknown persons while the petitioner was in custody in connection with Ahiyapur P.S. Case No. 879 of 2018, he was remanded in connection with the present case on mere suspicion and the statement made by some co-accused persons, who had also been taken into custody under suspicion. He further submits that the petitioner has not been placed on T.I. Parade nor has any
Patna High Court CR. MISC. No.2676 of 2019(3) dt.28-02-2019 2/3 incriminating article been recovered from his possession. It is further submitted that though the petitioner has been remanded in several other cases after his arrest in connection with Ahiyapur P.S. Case No. 879 of 2018, in all three other cases bail has been granted by this Court as well as other co-ordinate Bench of this Court. He thus, submits that the petitioner may be extended the privilege of bail.
Considering the aforesaid facts and circumstances of the case and also because the petitioner is not named in the first information report, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzuffarpur in connection with Ahiyapur P.S. Case No. 799 off 2018, corresponding to G.R. No. 4906 of 2018, subject to the following conditions:-
1. One of the bailors will be his own blood relative, preferably, father, mother, son, brother, sister and/or his wife.
2. The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
3. The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his

4. The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjana Mishra, J) Jagdish/- U T
