The petitioners seek bail in Naya Ram Nagar P.S. Case No. 82 of 2014, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.9398 of 2015 (3) dt.02-04-2015 2/2 The petitioners are not named in the FIR. The FIR was registered on the recovery of a dead body of a girl aged about 18 years. For the first time name of the petitioners figured in the case in the disclosure made by the informer of the police in para-47 of the case diary.
Fantush Yadav the co-accused is alleged to have confessed his guilt and disclosed the name of the petitioners. Except the so-called confessional statement of co-accused the police did not collect any tangible evidence. Similarly situated coaccused Lurki Paswan @ Amit Paswan and Deepak Yadav have already been enlarged on bail.
Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate/court concerned, Munger in connection with Naya Ram Nagar P.S. Case No. 82 of 2014 corresponding to Sessions Case No. 40 of 2015.
