2. The petitioner seeks bail in connection with Bhagwanpur Hat P.S. Case No. 190 of 2025, instituted for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Earlier, anticipatory bail of the petitioner has been rejected by a co-ordinate Bench of this Court vide order dated 03.09.2025 passed in Cr. Misc. No. 54773 of 2025.

4. The prosecution case, in short, is that all the accused persons including the petitioner came at the door of the informant and tried to commit loot. It is further alleged that when the informant objected, the accused persons assaulted the informant's son, due to which he sustained injuries.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submitted that no specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. It is next submitted that specific allegation of giving knife blow is against co-accused Dhanoj Sahani. The petitioner is in custody since 27.11.2025 and has got no criminal antecedent. Learned counsel for the petitioner further submits that other co-accused have been granted regular bail by this Court vide order dated 18.08.2025 passed in Cr. Misc. No. 54423 of 2025.

6. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
