This Court, having considered the materials on record, finds that the death of the father of the petitioner had taken place on 27.12.1999 and the application for appointment on compassionate ground was filed by the petitioner on 17.10.2007, i.e. beyond five years of the period prescribed by the State Government in its policy of compassionate appointment, would find no reason to now interfere with the impugned decision specially when the facts as stated in the counter affidavit, despite service of copy of the counter affidavit upon learned counsel for the petitioner on 22.01.2009, has also not been controverted by the

Patna High Court CWJC No.15903 of 2008 (2) dt.28-07-2015 2/2 petitioner by filing any rejoinder.

3. That being so, this writ application fails and is accordingly dismissed.
