JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-04-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 670 of 2017, disclosing offences under Sections 341, 323, 498(A) and 120B of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation as per F.I.R. is of demand of motorcyle and due to non fulfillment of the same, the petitioner and others were not ready to make her Bidai later on on she gave a birth to a son but her in laws used to torture and assault her for demand of Rs. Two lakhs and asked her to go to her parents house and on 27.03.2018, she was driven from her matrimonial house. Learned counsel for the complainant submitted that complainant also wants to live with the petitioner if she is kept with full care and dignity. No doubt, complainant had appeared before the court below in person, where, she had flatly refused to live with the petitioner However, considering the changed circusmtances, this application is disposed of with direction to the petitioner to surrender in the court below on 02.05.2019 and on that complainant -opposite party no.

2 shall also remain present there and the petitioner will file a petition to the effect that he is ready to keep the complainant with himself and also ready to take the complainant - opposite party no.
