JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-04-2015 Petitioner is languishing in custody since 20.03.2014 in a case registered for the offences punishable under Sections 17/18 of the N.D.P.S. Act.

From the possession of the petitioner 14 sachets of smack weighing 6.650 gms were recovered. It is submitted by learned counsel for the petitioner that recovery is little more than small quantity but much less than commercial quantity. Moreover co-accused Md. Hanan Ansari from whose possession the smack weighing 5.160 gms were recovered, has been granted bail vide Cr. Misc. No. 6716 of 2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.13131 of 2015 (2) dt.06-04-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge, N.D.P.S., Patna in connection with Special Case No. 24 of 2014, arising out of Rupaspur P.S. Case No. 54 of 2014.
