The petitioner is in custody since 23.11.2014 in connection with Gopalpur (Rangra) P.S. Case No. 479 of 2014 for the offence registered under sections 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though petitioner is not named in the FIR but subsequently on the basis of suspicion, he was taken into custody and his confessional statement was extracted by the police which has no evidentiary value. It is further submitted that the petitioner's wife fled away and solemnized her marriage with one Bambam Pandit for which, he had lodged the case against some persons with

It is further submitted that except the fact that there is suspicion against the petitioner, there is no cogent material on record so as to connect the petitioner with the said offence. Considering the period of custody and also the fact that petitioner has no criminal antecedent, let the petitioner, as mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Naugachia, Bhagalpur in connection with Gopalpur (Rangra) P.S. Case No. 479/2014.
