JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2017 The petitioner seeks regular bail in connection with Bettiah Town P.S. Case No. 302 of 2017, registered for offences punishable under Sections 20, 23, 25, 27(A) and 29 of the NDPS Act.
Allegation against the petitioner is of recovery of 25 gram of smack/charas.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case, which will appear from the fact that police, himself is not sure as to whether recovery is smack or charas. Further he has been in judicial custody since 01.05.2017.
Heard leaned A.P.P. also.
Having heard both sides, considering the fact and
Patna High Court Cr.Misc. No.55196 of 2017 (2) dt.22-11-2017 circumstances of the case and nature of recovery, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismiss.
However, the trial court is directed to expedite the trial and try to conclude it within a period of nine months. (Vinod Kumar Sinha, J) sunil/- U T
