The petitioner is apprehending his arrest in connection with Yogapatti Shanichari P.S.Case No.309 of 2018 , registered for offences punishable under Sections 341, 323, 307, 379, 385, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of demanding Rangdari and also assaulting the informant causing injury to him.

Submission of the learned counsel for the petitioner is that as a matter of fact a tempo met with an accident for which he has taken iron chain from the shop of the petitioner due to which scuffle took place and both sides have received injuries. There is case and counter case and furthermore there is

Patna High Court CR. MISC. No.3758 of 2019(3) dt.08-03-2019 2/2 allegation of assault by Dabiya but the injuries are found to be caused by hard and blunt substance though the injuries are grievous in nature.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Yogapatti Shanichari P.S.Case No.309 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
