JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 484 of 2018, disclosing offences under Sections 498(A)/34 of the Indian Penal Code. Case is under Section 498(A) of the Indian Penal Code and allegation against the petitioner is of subjecting his wife to cruelty with respect to demand of dowry. Submission of learned counsel for the petitioner is that he is still ready to keep her, but the problem is that he has been posted at Patna and residing at barrack, but he is ready to keep the complainant with his father and mother. Heard learned A.P.P. as well as learned counsel for the complainant, they have submit that the complainant is also

Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below on 12.04.2019 and file a petition that he is ready to keep the complainant with dignity and care and the opposite party no.2 shall also remain present on that day and the petitioner shall take her to his father's house on that day itself and on such, the provisional bail earlier granted to the petitioner vide order dated 25.01.2019 shall continue for six months and during that period the learned court below will find the conduct of both the parties by calling them in the first week of each month, specially the conduct of the petitioner and once the learned court below is satisfied with the conduct of both the parties, he shall confirm the provisional bail of the petitioner otherwise, he is free to pass any order or orders as he deems fit and proper.
