JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Ladaniya P.S. Case No. 158 of 2015 registered under Sections 323, 342, 504, 506 and 354(B)/34 of the Indian Penal Code. The prosecution case is that on 12.11.2015 at about 9.05 P.M. in the night, Rita Kumari (Bhanji of the informant) was going to hand over food to the informant at his second house situated at Panchayat Bhawan. In the way, petitioner along with two others pressed her mouth and carried her towards orchard. On raising alarm, informant rushed there and caught hold the petitioner and rushed him to his father, Niranjan Yadeav @ Nirdev Yadav, on which, petitioner and his father used to abuse him and

Patna High Court Cr.Misc. No.1130 of 2016 (3) dt.19-02-2016 started to assault with the informant.

Learned counsel for the petitioner submits that petitioner and the informant are co-villagers and due to dirty village politics petitioner has falsely been implicated in this case. It is further submitted that petitioner has no criminal antecedent and is in custody since 13.11.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Madhubani, in connection with Ladaniya P.S. Case No. 158 of 2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
