The petitioner seeks pre-arrest bail in connection with Sahebpur Kamal P.S. Case No.182 of 2018 registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that co-accused Soni Devi, who has purchased the land has already been granted pre-arrest bail by a Bench of this Court vide order dated 04.01.2019 passed in Cr. Misc. No. 67356 of 2018.
As far as the petitioner is concerned, admittedly he is the deed writer. He had no concern with the sale or purchase of land. He discharged his duties in his professional capacity and
Patna High Court Cr.Misc. No.2740 of 2019(2) dt.22-01-2019 2/2 drafted the deed in good faith as per direction of the seller and purchaser and, therefore, he cannot be held accountable for any wrong, which may have been done by other accused persons. Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Considering the nature of allegations made in the first information report and the submissions made above, in the event of arrest or surrender in the court below, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Begusarai in connection with Sahebpur Kamal P.S. Case No. 182 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
