The petitioner is accused in connection with Kesaria P.S. Case No. 232 of 2015 registered under Sections 147, 148, 341, 323, 324, 307, 354, 379, 504 and 506 of the Indian Penal Code.
The accusation is that petitioner along with five others named in the F.I.R. reached at the door of the informant and abused his father and mother. At that time, petitioner caused injury at the head of father of the informant through Farsa, on which, he become unconscious and fell down.
Learned counsel for the petitioner submits that while the allegation against the petitioner is to give Farsa blow at the
Patna High Court Cr.Misc. No.1423 of 2016 (3) dt.22-02-2016 head of Nand Kishore Sah, father of the informant, but two lacerated would were found on the person of the father of informant of be grievous in nature. It is further submitted that petitioner and the informant are next door neighbor and the occurrence took place due to land dispute. It is further submitted that petitioner has no criminal antecedent and is in custody since 09.09.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Motihari, East Champaran, in connection with Kesaria P.S. Case No. 232 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
